No moral justification is possible. It is for this reason that the Supreme Court of the United States relies on the imaginary "social contract" when suits are brought. This conceptiual, involuntary agreement (notice the inherent conflict in this phrase) between all U.S. citizens is as fictional and offensive as Divine Right, and bears no more relationship to the truth or the maintenance of individual freedoms than the tenets of communism.
